Angrezistaan (“Company,” “we,” “us,” or “our”) operates the Angrezistaan mobile application and website (https://angrezistaan.com) (collectively, the “Platform”), which provides online English learning services, including lessons, quizzes, text-to-speech, speech recognition, typing games, and progress tracking for students.

These Terms and Conditions (“Terms”) govern your access to and use of the Platform and its services (“Services”). For users under 18 years of age, parental consent is required, and the term “you” refers to the parent/guardian and/or the child (aged 13 or older), as applicable. The term “Users” includes both parents/guardians and children using the Platform.

We reserve the right to modify these Terms at any time by posting the updated version on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. Additional terms may apply to specific services or promotions and are incorporated by reference into these Terms.

1. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you are a parent or guardian providing consent for a child aged 13 or older to use the Platform, you agree to be responsible for their compliance with these Terms. If you do not agree with these Terms, you must stop using the Platform immediately.

2. Description of Services

The Platform offers online English learning tools designed to help students improve their language skills. Services include, but are not limited to:

• Interactive lessons with text-to-speech and speech recognition.
• Quizzes and typing games to enhance vocabulary and grammar.
• Progress tracking to monitor learning outcomes.
• Virtual classroom features accessible anytime, anywhere.

We aim to provide a flexible and engaging learning environment, but we reserve the right to modify or discontinue any Service at our discretion.

3. Eligibility and Account Registration

3.1 Age Requirements

• Users must be at least 13 years old to use the Platform.
• Users under 18 require parental or legal guardian consent to register and use the Services. Parents/guardians are responsible for supervising their child’s activities on the Platform.
• Users under 13 are not permitted to use the Platform.

3.2 Account Creation

To access certain features, you must create an account by providing accurate information, such as:

• Name
• Email address
• Date of birth (to verify age)
• Contact details
• Parental consent details (if applicable)

You may also register via social media accounts (e.g., Google, Facebook), subject to their terms.

3.3 Account Security

• Your account (“User Account”) is for your exclusive use only. Sharing your User Account or credentials with others is prohibited and may result in suspension or termination.
• You are responsible for maintaining the confidentiality of your User Account and for all activities under it.
• Notify us immediately at support@angrezistaan.com if you suspect unauthorized use of your account.
• We are not liable for any losses due to unauthorized access resulting from your failure to secure your account.

4. Trial Classes

We may offer one (1) free trial session to new users to experience our Services. Only one trial session is permitted per user. Attempting to access multiple trials using different accounts or email addresses without our prior written permission is a violation of these Terms and may result in account suspension.

Trial sessions are subject to these Terms.

5. Curriculum and Content

We provide access to educational materials, including lessons, quizzes, audio, video, and interactive tools (“Curriculum”). The Curriculum is designed to support English learning and may be updated or revised at our discretion.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Curriculum for personal, non-commercial educational purposes only, subject to these Terms.

6. License to Use

We grant you and your child (if applicable) a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes, such as:

• Participating in lessons and quizzes.
• Using speech recognition and text-to-speech features.
• Viewing progress reports.

You may not:

• Reproduce, distribute, modify, or create derivative works of the Curriculum or Platform content without our prior written consent.
• Share access to the Platform with unauthorized users.
• Use the Platform for any commercial purpose.

We reserve the right to suspend or terminate your access if you violate this license.

7. Intellectual Property Rights

All content on the Platform, including the Curriculum, text, graphics, logos, audio, video, software, and underlying code, is owned by Angrezistaan or its licensors and protected by intellectual property laws. This includes:

• Lessons, quizzes, and interactive tools.
• Audio and video recordings created during lessons.
• Images, icons, and designs.

You may not:

• Copy, download, distribute, or reproduce any Platform content without our prior written permission.
• Record, screenshot, or share lessons, audio, or video from the Platform.
• Use our trademarks, logos, or designs without consent.

Any unauthorized use of our intellectual property is a breach of these Terms and may result in legal action.

8. Use of the Platform by Children

If you are a parent or guardian consenting to your child’s use of the Platform:

• You confirm you have the legal authority to enter this agreement on their behalf.
• You consent to your child participating in lessons, quizzes, and other activities, including microphone access for speech recognition.
• You agree to supervise your child’s use of the Platform and accept responsibility for their actions.
• You acknowledge that lessons may be recorded for quality assurance and educational purposes, with your consent as per our Privacy Policy.

9. Payments and Refunds

9.1 Subscription Fees

The Platform offers paid Services through subscription plans. You agree to pay the fees for the plan you select, as displayed at the time of purchase. Fees are subject to applicable taxes.

9.2 Payment Methods

Payments are processed via third-party payment gateways (e.g., credit/debit cards, online banking, wallets). You authorize us to charge your selected payment method for the chosen plan, including automatic renewals unless canceled.

9.3 Refund Policy

• Refunds are processed within 24-72 hours of a valid request, subject to verification.
• Refunds are limited to fees paid for Services not rendered (e.g., canceled subscriptions).
• To request a refund, contact us at support@angrezistaan.com with your account details.
• We are not liable for unauthorized transactions, fraud, or errors by third-party payment providers.

9.4 Fee Changes

We reserve the right to modify fees at any time. Changes will be posted on the Platform and effective immediately for new subscriptions or upon renewal for existing ones.

10. User Content

You and your child may submit content to the Platform, such as quiz answers, audio recordings, or images (“User Content”). By submitting User Content, you:

• Grant us a worldwide, royalty-free, non-exclusive, perpetual license to use, store, reproduce, and display User Content for educational and operational purposes (e.g., progress tracking, lesson improvement).
• Confirm that User Content is your own or you have permission to use it.
• Agree not to submit content that is:
• Offensive, defamatory, obscene, or unlawful.
• Infringing on third-party rights (e.g., copyrights, privacy).
• Harmful, such as viruses or malware.

We may review, moderate, or remove User Content at our discretion. You are responsible for ensuring User Content complies with these Terms.

11. Third-Party Services and Links

The Platform may integrate third-party services (e.g., payment gateways, social media logins) or link to external websites. These services are governed by their own terms and privacy policies. We are not responsible for:

• The content, security, or practices of third-party services.
• Any losses or damages resulting from your use of third-party services.

Use third-party services at your own risk.

12. Rules of Conduct

You agree to use the Platform responsibly and in compliance with applicable laws. You must not:

• Hack, modify, or reverse-engineer the Platform.
• Use the Platform for illegal, harmful, or unauthorized purposes.
• Share false, misleading, or offensive content.
• Impersonate others or misuse another user’s account.
• Distribute spam, viruses, or malicious software.
• Attempt to bypass our security measures.

We may monitor usage to ensure compliance and reserve the right to investigate violations.

13. Limited Liability

The Platform and Services are provided “as is” without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose. To the fullest extent permitted by law:

• We are not liable for direct, indirect, incidental, or consequential damages arising from your use of the Platform, including loss of data, profits, or opportunities.
• Our liability is limited to the amount you paid for Services in the preceding 12 months.
• We do not guarantee uninterrupted, error-free, or secure access to the Platform.
• We are not responsible for:
• Inaccurate or inappropriate content shared by users.
• Technical issues beyond our control (e.g., internet outages, device failures).
• Actions of third parties, including tutors or other users.

If you encounter inappropriate behavior (e.g., abusive language by a tutor), report it immediately to support@angrezistaan.com. We will investigate and take action as per applicable laws, but we disclaim liability for such incidents.

14. Termination

We may suspend, restrict, or terminate your access to the Platform if you:

• Violate these Terms.
• Engage in illegal or harmful activities.
• Fail to pay applicable fees.

You may terminate your agreement by deleting your account and ceasing use of the Platform. Termination does not affect accrued rights or obligations, including payment responsibilities.

15. Indemnification

You agree to indemnify and hold harmless Angrezistaan, its affiliates, employees, and agents from any claims, damages, or losses arising from:

• Your or your child’s violation of these Terms.
• Your or your child’s User Content.
• Unauthorized use of the Platform or intellectual property.
• Any breach of third-party rights.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, with exclusive jurisdiction in the courts of Prayagraj, Uttar Pradesh. Disputes arising from these Terms will be resolved through arbitration under the Indian Arbitration and Conciliation Act, 1996:

• Arbitrators: Three (one appointed by each party, the third by the two appointees).
• Language: English.
• Venue: Prayagraj, Uttar Pradesh.
• Binding Decision: The arbitrators’ decision is final.

We may seek injunctive relief to protect our intellectual property or confidential information.

17. Severability

If any provision of these Terms is found invalid or unenforceable, it will be severed to the extent necessary, and the remaining provisions will remain in effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any additional guidelines or rules posted on the Platform, constitute the entire agreement between you and Angrezistaan regarding the use of the Platform.
